Answers to Some Common Questions About Drunk Driving, Criminal Appeals and Computer Crimes:

How can a lawyer help me with a Drunk Driving Ticket?  A skilled and experienced lawyer should know after reading a police report what the major issues are in a case. The  lawyer could prepare Motions to Suppress evidence if the police violated your constitutional rights.  Police mistakes such as conducting an improper search of your car or not having proper justification to stop your car on the road could result in dismissal.  More importantly many DWI cases result in compromise and plea bargains.  A good lawyer will be able to negotiate for you the best deal a prosecutor is willing to make by pointing out the problems with a case likely to cause issues at trial.  Further, a specialist in drunk driving will know how to present you and your history and accomplishments at the time of sentencing.  That lawyer should be able to put you in the best light before the sentencing judge.  In the end, proper evaluation of the legal issues in a case, great negotiating skill and skillful advocacy at sentencing could save you a trip to jail or prison or even result in the sentence being tailored to such a degree that you can live with the result.  

Are speeding tickets a misdemeanor?  No.  Speeding tickets are classified as a civil infraction.  However, there are circumstances where speeding tickets could become a misdemeanor such as traveling at an extremely high rate of speed.  This would involved situations such as traveling in excess of 100 mph on a residential street or perhaps traveling 130 mph on a freeway.  In that event, a police officer might ticket a driver for operating at such a high rate of speed that it constitutes reckless driving.  Therefore, speeding in that circumstance would become a misdemeanor.  There are other situations where high rates of speeding combined with drunk driving or other bad driving could result in higher charges that amount to a misdemeanor.  But, speeding in and of itself is almost always a civil infraction.  We regularly help clients with speeding tickets with good results.

Can I appeal a guilty plea to the Michigan Court of Appeals?  A few years ago the voters of Michigan made it much more difficult to appeal a guilty plea to the Michigan Court of Appeals.  Today appeals of guilty pleas in criminal cases are by leave of the court.  That means you have to ask permission of the court to appeal.  Permission to appeal a guilty plea is rarely granted.  However, it is possible where there has been fraud, duress or other illegal or unethical behavior that causes you to wrongly plead guilty to the crime.  

What is the difference between dui and dwi?  The difference between driving under the influence and driving while intoxicated is a matter of proof for a prosecuting attorney at the time of trial.  States have moved away from the requirement that the prosecutor show that a person was under the  influence of intoxicating liquor.  Instead the law in many states now lets a prosecutor simply show that a person had a blood alcohol content in excess of the legal limit to be found guilty.  The state law simply defines the legal limit for blood alcohol content, which in nearly all states is .08 BAC, and creates a presumption that a person driving with a BAC in excess of the legal limit is intoxicated.  Thus, the defense that one can hold their liquor and still drive is irrelevant.  All the jury is suppose to look at is the score!  

Is looking at pornography on my computer a crime?  No.  However, downloading and sharing images of children are very serious computer crimes in most states.  In Michigan having just three images could result in charges that carry a seven years in prison term and a requirement that you register as a sex offender for 25 years.  The use of computers as instruments of crime today is more common.   Computer crimes such as fraud, embezzlement, violating wiretapping laws by hacking and launching malicious code to other computers are serious felony crimes.  Computer crimes, especially child pornography, has resulted in formation of federal and local police task forces.  These police are constantly monitoring web traffic to find computer crimes and prosecute those using a computer to share or distribute child pornography.  If you are contacted by one of these police task forces you should immediately seek competent and experience representation by a computer crime criminal defense lawyer.  In the federal criminal justice system having child pronography is an almost always a certain prison sentence.
